Legal Expert – Health Innovation & Data Governance

About the role
As a Legal Expert in Health Innovation & Data Governance you will join the Department for Ethical, Legal & Societal Implications (ELSI) at BBMRI‑ERIC. You will translate GDPR, the European Health Data Space, the AI Act and the MDR/IVDR into practical governance frameworks that enable biobanks, researchers and innovators to share health data and samples lawfully across borders.
Key responsibilities
- Draft, review and negotiate cross‑border health research instruments such as data‑transfer, material‑transfer, data‑access and consortium agreements.
- Assess data‑access conditions, management policies and governance models against GDPR and national law, advising on consent, pseudonymisation and DPIAs.
- Prepare BBMRI‑ERIC and its Nodes for the European Health Data Space, focusing on data‑holder duties, access frameworks and opt‑out mechanisms.
- Advise on the intersection of the AI Act, MDR/IVDR and health research, monitoring EU regulatory developments.
- Communicate legal insights to external stakeholders and collaborate with an interdisciplinary ELSI team.
Required profile
- University degree in law (Master, LL.M., Magister/Diplom or equivalent); PhD or additional qualification in health law, data protection or bioethics is a plus.
- Minimum 5 years of professional experience in health law, with at least 3 years managing interdisciplinary, international projects (e.g., Horizon Europe).
- Proven experience drafting and negotiating DTAs, MTAs, DPAs and similar agreements.
- Advanced knowledge of GDPR in the health‑data domain, and working knowledge of the European Health Data Space, AI Act, MDR/IVDR.
- Fluent English, strong presentation and moderation skills, and willingness to travel moderately.
